Terms of Service

These Terms of Service ("Terms") frame the agreement between you (the customer) and PoolSide Phoenix ("we," "our," or "us") regarding your use of our pool cleaning, maintenance, and repair services, as well as communications associated with those services.

1. Acceptance of Terms

By engaging PoolSide Phoenix for services or opting into our communications, you agree to these Terms. If you do not agree to these Terms, please do not use our services.

2. Communications and SMS Terms

We utilize Skimmer, a specialized pool service platform, to handle our dispatching, route completion logs, and customer communications. While Skimmer powers our backend, PoolSide Phoenix remains your service provider and the sender of SMS messages directed to you.

By opting into SMS communications, you agree to the following:

  • Service Opt-In: You consent to receive conversational, transactional, and informational text messages (e.g., service completion reports, invoice links, quote details, & scheduling updates) from PoolSide Phoenix.
  • Consent Independence: Consent to receive text messages is not a condition of purchasing any goods or services from PoolSide Phoenix.
  • Message Rates: Message and data rates may apply. Check with your mobile carrier for details.
  • Opt-Out: You may cancel the SMS service at any time by replying STOP to any message you receive from us. After sending STOP, we will send a final message confirming your opt-out, and you will no longer receive text messages from us unless you choose to opt back in.
  • Help & Support: If you experience any issues or need assistance with the messaging program, reply with the keyword HELP for more assistance, or you can get help directly at PoolsidePhoenix@gmail.com or (602) 456-0016.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.

3. Services

All services are provided as described in your quote or service agreement. We reserve the right to refuse service or cancel ongoing services at our discretion. Service frequency, chemicals used, and specific treatments will be determined based on your selected service plan and current pool conditions.

4. Payment and Billing

Invoices are delivered typically via your preferred communication method (email or SMS). Prompt payment is required to ensure uninterrupted service. We reserve the right to suspend service for unpaid balances.

5. Limitation of Liability

PoolSide Phoenix is not liable for structural defects, pre-existing conditions, or general wear and tear of your pool and its equipment. Our liability is limited to the direct damages strictly caused by our gross negligence during service delivery.

6. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any substantial changes by updating the documentation on this page. Your continued use of our services following any changes constitutes your acceptance of the revised Terms.
